These Terms & Conditions apply to all online courses and in-person workshops offered by Yinske Silva (hereinafter “we”, “us”, or “the provider”) through the websites voice-meditation.com. By registering for any offering, you agree to these terms in full.

These terms comply with the EU Consumer Rights Directive (2011/83/EU), the Dutch Civil Code (Burgerlijk Wetboek, Book 6), and the EU Unfair Contract Terms Directive (93/13/EEC).

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

  • Provider: Yinske Silva, operating under the trade name Voice Meditation, registered at KvK 34357769.
  • Participant: any individual or legal entity who registers for an online course or in-person workshop offered by the provider.
  • Consumer: a participant acting outside the scope of a professional or business activity.
  • Online course: a pre-recorded or live digital learning programme delivered via an online platform, accessible after purchase.
  • In-person workshop: a physical, location-based training session, masterclass, or workshop with a fixed date and venue.
  • Agreement: the contract formed between the provider and the participant upon successful registration and payment.

Article 2 – Applicability

These Terms & Conditions apply to all offers, agreements, and services provided by the provider.

Deviations from these terms are only valid if agreed upon explicitly and in writing between both parties. These terms supersede any earlier agreements or communications on the same subject matter.

Article 3 – Registration & Agreement

3.1  Registration for an online course or in-person workshop takes place via the website. The agreement is formed at the moment the participant completes the registration and payment process.

3.2  The participant will receive an automatic confirmation by email. For in-person workshops, this confirmation constitutes proof of registration.

3.3  Places are allocated in order of receipt of payment. The provider reserves the right to cancel a session if minimum participant numbers are not reached (see Article 6).

3.4  By completing registration, the participant confirms they have read and accepted these Terms & Conditions.

3.5  Participants must be at least 18 years of age, or have written consent from a parent or legal guardian.

Article 4 – Pricing & Payment

4.1  All prices are stated in euros (EUR) and include VAT (BTW) unless explicitly stated otherwise.

4.2  Payment is processed at the time of registration through the payment method offered on the website.

4.3  If a payment fails or is reversed, the registration is automatically cancelled. The provider is not liable for any loss of access resulting from failed payment.

4.4  Invoices are available on request and will be issued with the provider’s full business details.

Article 5 – Right of Withdrawal (Consumers Only)

Online courses

When you purchase an online course, you have the right to withdraw from the agreement within 14 calendar days of purchase, without giving any reason (the “cooling-off period”).

However, if you expressly consent to immediate access to the course content and acknowledge that you will thereby lose your right of withdrawal, the right of withdrawal does not apply once you have begun accessing the course. This consent will be requested from you explicitly during the checkout process.

If you have not begun accessing the course, you may withdraw within 14 days by notifying us at info@voice-mediation.com. We will refund all payments received within 14 days of receiving your withdrawal notice, using the same payment method you used.

 

In-person workshops

For in-person workshops taking place on a specific date, the statutory right of withdrawal does not apply, as these fall under the exemption for leisure and cultural activities on a specific date under Article 16(l) of the Consumer Rights Directive.

Cancellation rights for in-person workshops are governed by Article 6 below.

 

How to exercise your right of withdrawal:

Send a clear written statement to: info@voice-meditation.com, stating your name, the course or workshop purchased, and your decision to withdraw. You may use the standard EU model withdrawal form (available on request), but this is not required.

Article 6 – Cancellation by the Participant

6.1  Online courses: Cancellation is governed by the right of withdrawal described in Article 5. Outside the withdrawal period, no refund is available.

 

6.2  In-person workshops:

  • Cancellation more than 7 calendar days before the workshop date: free of charge. A full refund will be issued within 14 days.
  • Cancellation within 7 calendar days of the workshop date: no refund is available.
  • Non-attendance without prior cancellation: no refund is available.

 

6.3  Participants may at any time arrange for a substitute participant to take their place, provided the provider is notified in advance by email and the substitute meets any applicable requirements.

Article 7 – Cancellation or Changes by the Provider

7.1  The provider reserves the right to cancel an in-person workshop if the minimum number of participants is not reached, or due to unforeseen circumstances such as illness of the instructor. Participants will be notified no later than 7 calendar days before the start date.

7.2  In the event of provider cancellation, participants will receive either a full refund or the option to transfer their registration to a rescheduled date or alternative session, at no additional cost.

7.3  The provider is not liable for any additional costs incurred by participants (such as travel or accommodation) as a result of provider cancellation.

7.4  The provider reserves the right to change the venue, date, or format of an in-person workshop where reasonably necessary. Participants will be notified as early as possible and offered the option to cancel for a full refund if the change is significant.

7.5  Online courses may be updated, revised, or supplemented over time. Access to updated content is included for the duration of the access period stated at the time of purchase.

Article 8 – Access & Delivery

8.1  Online courses: Access to the online course platform will be granted within 24 hours of confirmed payment. The access period and any limitations will be communicated clearly on the product page before purchase.

8.2  In-person workshops: Participation is only permitted upon presentation of the registration confirmation. Latecomers may be refused entry at the provider’s discretion.

8.3  The provider is not responsible for technical issues on the participant’s side (e.g. internet connection, device compatibility) that prevent or limit access to online course content.

Article 9 – Intellectual Property

9.1  All course materials, recordings, documents, audio files, video content, and methods provided by the provider are protected by copyright and other intellectual property rights.

9.2  Participants may use course materials solely for personal, non-commercial learning purposes. Copying, reproducing, distributing, sharing, or reselling any materials – in whole or in part – is strictly prohibited without the prior written consent of the provider.

9.3  Recording of in-person workshops (audio, video, or photography) is not permitted unless explicitly authorised by the provider in advance.

9.4  Sharing login credentials for online courses with third parties is not permitted. Each registration is for a single individual.

Article 10 – Confidentiality

10.1  Participants agree to treat as confidential any personal information shared by other participants during workshops or courses, and not to disclose such information to third parties.

10.2  The provider treats all participant data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR). See our Privacy Policy for full details.

Article 11 – Conduct & Exclusion

11.1  Participants are expected to behave respectfully towards other participants and the instructor at all times, in both online and in-person settings.

11.2  The provider reserves the right to exclude a participant from a session or course in the event of misconduct, harassment, or failure to comply with reasonable instructions. No refund will be issued in such cases.

11.3  In the event of non-payment, the provider may refuse access to services. Outstanding amounts remain due.

Article 12 – Liability

12.1  The provider endeavours to deliver all courses and workshops with care and expertise. The provider’s obligations are best-effort obligations; no specific result is guaranteed.

12.2  The provider accepts no liability for:

  • indirect or consequential damages;
  • loss of income or business opportunities;
  • personal injury, loss, or damage to property occurring during in-person workshops, except where caused by the provider’s gross negligence or wilful misconduct;
  • technical failures outside the provider’s control affecting access to online courses.

12.3  The provider’s total liability to a participant is in all cases limited to the amount paid by the participant for the relevant course or workshop.

12.4  Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, or for any other liability that cannot be excluded under mandatory EU or Dutch law.

Article 13 – Force Majeure

13.1  The provider is not liable for any failure or delay in performing its obligations where this results from circumstances beyond the provider’s reasonable control, including but not limited to natural disasters, pandemic measures, government restrictions, power failures, or transport disruptions.

13.2  In the event of force majeure affecting an in-person workshop, the provider will make reasonable efforts to reschedule. If this is not possible within a reasonable time, participants will receive a full refund.

Article 14 – Complaints

14.1  If you have a complaint about our services, we ask you to contact us first by email at info@voice-mediataion.com. We will respond within 14 days.

14.2  If you are a consumer and we are unable to resolve your complaint together, you may submit your complaint to the relevant dispute resolution body. As a consumer in the Netherlands or the EU, you can also use the European Online Dispute Resolution (ODR) platform at: ec.europa.eu/consumers/odr.

14.3  Filing a complaint does not suspend the participant’s payment obligations.

Article 15 – Governing Law & Jurisdiction

15.1  These Terms & Conditions are governed by Dutch law.

15.2  Any disputes arising from or in connection with these terms will be submitted to the competent court in Amsterdam, the Netherlands.

15.3  For consumer participants residing in another EU member state: you retain the right to invoke the mandatory consumer protection provisions of the law of your country of residence, where these afford you greater protection than Dutch law.

Article 16 – Changes to These Terms

16.1  The provider reserves the right to update these Terms & Conditions. Any changes will be published on the website and will take effect 30 days after publication, except where a longer notice period is required by law.

16.2  If you have already registered for a course or workshop before a change takes effect, the terms applicable at the time of registration continue to apply to that booking.
